Why might injured workers hesitate to file compensation claims?

On Behalf of | Nov 9, 2024 | Workers' Compensation |

Injuries in the workplace can be a traumatic experience, not just physically but emotionally and financially as well. Workers’ compensation systems were established to provide protection and support for workers who get injured or sick as a result of their jobs.

Through this system, workers are theoretically entitled to medical care, rehabilitation and compensation for lost wages. However, despite these available benefits, many injured workers still hesitate to file a workers’ compensation claim.

Fear of retaliation or job loss

One of the most common reasons workers hesitate to file compensation claims is the fear of retaliation. Some employees worry that their employer may view them as a liability or uncommitted to their job if they file a claim. While workers’ compensation laws include protections against retaliation, this does not always stop some employers from acting unfairly. Employees might fear that they will:

  • Face workplace discrimination
  • Receive fewer hours
  • Be passed over for promotions

In some cases, workers even worry that they could lose their jobs altogether.

Concerns about workplace culture and stigma

The culture of a workplace plays a significant role in how employees view and approach workers’ compensation claims. In environments where hard work and resilience are highly valued, workers might fear being seen as weak or expendable if they report an injury. This is particularly prevalent in industries such as:

  • Construction
  • Manufacturing
  • Emergency services, where toughness is often emphasized

In these settings, the stigma surrounding injury and recovery can make employees reluctant to come forward, even if they are genuinely hurt. This fear of social judgment from coworkers or supervisors can be a powerful deterrent, potentially preventing employees from seeking help when they need it most.

Injured employees who are hesitant to file for compensation for whatever reason can benefit from unrelenting legal support. The right legal team can educate an employee about their rights and the legal avenues they can explore to receive fair compensation.
