Injured police officers: Workers’ compensation and code 4850

On Behalf of | May 26, 2025 | Police/fire Work Injuries |

Police officers put their lives on the line every day, facing unpredictable dangers in the line of duty. Like everyone else, they can experience overwhelming financial and medical burdens after work-related injuries.

California law provides essential protections through workers’ compensation and Labor Code Section 4850 benefits. Together, these solutions provide police officers with the financial support they need while recovering.

Workers’ compensation for police officers

Workers’ compensation covers medical expenses, lost wages and rehabilitation costs for officers injured on duty. Unlike standard workers’ compensation, which typically provides two-thirds of an employee’s salary, injured police officers in California may qualify for enhanced benefits under Labor Code 4850.

Understanding 4850 benefits

Under Labor Code Section 4850, eligible officers can receive full salary for up to one year while recovering from a work-related injury. This benefit is tax-free and does not require the use of sick leave. After one year, officers may transition to standard workers’ compensation benefits if they remain unable to work.

How 4850 fits into workers’ compensation

Labor Code 4850 is a special provision within California’s workers’ compensation system, designed specifically for public safety employees. While most injured workers receive temporary disability benefits at a reduced rate, 4850 benefits provide full salary continuation, ensuring officers can recover without financial strain.

Once the 4850 period ends, officers may still qualify for temporary disability payments under traditional workers’ compensation.

Eligibility for 4850 benefits

Benefits apply to full-time public safety employees, including city police officers and sheriffs. However, administrative staff and part-time employees are generally excluded. To secure benefits, injured officers must report the injury promptly, seek medical evaluation, and file a workers’ compensation claim.

Legal guidance can be invaluable in helping injured public servants receive the full benefits they deserve.
