Workers' Compensation
Workers' Compensation is a "no-fault" legal system.
An injured worker does not have to prove that an employer or a co-worker did something to cause an injury.
Additionally, an employer cannot dispute your injury by claiming that your injury was caused by your own carelessness or recklessness.
WHAT IS A DATE OF INJURY?
The date of injury is the day an employee is hurt
or first becomes aware that a work related condition or illness was caused by their job
TWO TYPES OF WORK INJURIES
Specific Date of Injury vs. A Cumulative Trauma
A specific date of injury occurs on the day a work-related accident happens
A cumulative trauma injury occurs if the injury developed over time - the date you first realized your job was causing you condition
